Definitions

In this Policy:

Smart device: It refers to the non-standard computing equipment produced or manufactured by hardware manufacturers, with a man-machine interface and transmitting information through wireless networks.

Application: It refers to the mobile application TERRAINA App provided by TERRAINA, which can help end users to remotely control smart devices and connect to the Internet of Things (IoT) platform.

I. The way in which we collect and use your personal information

(I) The information collected by us

1. The personal information we collect and use with your authorization

In order to provide you with our services, you are required to provide the necessary information to be entitled to such services. We will only collect the information necessary to achieve specific, particular, clear and legal purposes, and ensure that this information will not be further processed inconsistent with the above purposes. You have the right to choose whether to provide the information required by us, but in most cases, if you refuse to provide such information, we may not be able to provide you with the corresponding services or respond to your problems.

(1) Connection to smart devices

In order to provide you with services and allow you to securely connect and manage smart devices, we may collect your Wi-Fi information, location information, account login information, and information related to your mobile phone, smart device and account. Such information will be used to provide you with the functions such as pairing and connecting with smart devices, discovering nearby devices, and device management, as described below.
  • Registered account information: When you register account with us, we will collect your account name and contact information, including your email address, phone number, user name and password. During your interaction with our products, we will further collect nicknames, country codes, language preferences or time zone information from your account.
  • Connect to smart devices via Wi-Fi/Bluetooth: Wi-Fi information (SSID, BSSID, Wi-Fi password), device ID, and MAC address for Bluetooth on the device.

(2) Mobile device information

When you interact with our products, in order to ensure your normal use of our services, improve and optimize our service experience and ensure the security of your account, we will automatically collect mobile device information, including mobile device model, login IP address, wireless connection information, operating system type and version, app version number, push notification identifier, log file and mobile network information. Meantime, we will collect your software version number. In order to ensure the safety of operating environment or provide services, we will collect the application installation list of apps.

(3) Usage information

During your interaction with our website and services, we will automatically collect usage information related to visiting, clicking, downloading, sending/receiving messages and other uses of our website and services. Log information: When you use our app, in order to improve your user experience, system and exception logs will be uploaded for analysis, including your IP address, language, operating system version, and date or time of access, so that we can accurately identify problems and help you solve problems during service use.

(4) Information on smart device

When you use a smart device, we will collect the information inherent to the smart device itself and the information generated by your use of the smart device.

Basic information of smart devices: When you use the smart devices connected with our products or services, we will collect basic information of the smart devices, including their name, device ID, online status, activation time, machine location, running status, maps, firmware version and upgrade information.

(5) Smart scene

A map of the surrounding grassland environment generated by your smart device, and photos/videos recorded by the device vision sensor in the grassland environment.

2. Information collected based on the additional functions provided

In order to provide you with more convenient and better products and/or services and strive to improve your experience, we will collect and use your personal information in the following additional services provided to you. If you don't provide such information, it won't affect your use of the basic services of TERRAINA App, but you may not be able to access to additional services, including:

(1) User feedback

When you accept our service and submit feedback and suggestions related to the service to us, we will collect your email address, mobile phone number and feedback information (uploaded pictures or videos), as well as the submitted problem log, all of which will be used by us to timely deal with your app problems and smart device failures, and to contact you.

(2) Additional services based on location information:

When you enable the location function of your mobile device through system authorization and use location-based services, we will collect and use your location information to enable you use TERRAINA App to pair network with smart devices. The reason of obtaining location permission in "Add Device": Enter "Add Device" and perform Bluetooth scanning based on the function of searching nearby devices. At this time, we will be authorized to perform Bluetooth communication. Because we need to collect your location information during Bluetooth scanning, you need to turn on Bluetooth and request location to add a device, otherwise your "Add Device" function will not be enabled. You can disable the location service in the mobile device system to stop our collection of your location information.

(3) Additional services based on camera/webcam:

You can use this function to scan code after enabling the camera/webcam permissions, so as to add the device you purchased and shoot a video. Please be aware that even if you have agreed to enable the camera/webcam, we will only obtain information when you take the initiative to scan the code and shoot with the camera/webcam. The code scanning function can be used to collect the information of light sensor and judge whether it is necessary to show the flash function according to the data of light sensor.

(4) Additional services for permitting and uploading pictures/videos based on photo albums (photo gallery/video library):

You can use this function to upload your photos/pictures/videos after enabling the photo album permissions, so as to realize the function of reporting problems in the use of equipment and providing proof. When you report a problem in the use of the equipment, we will locate your problem through the photos/pictures you uploaded.

(5) Additional services based on storage permission:

We apply for this permission from you to ensure the stable operation of the client end. After you enable our permission to read/write your device storage, we will read or write the necessary information of pictures, files and crash log information from or into your device storage space, so as to provide you with the function of publishing information or recording crash log information locally.

(6) Additional functions based on message notification permission:

We apply for this permission from you to send you the notifications about products or services, especially when we need to send you an alarm after you purchase relevant services, so that you can grasp the real-time situation.

(7) Related additional services based on Bluetooth technology:

You can use the Bluetooth function after enabling Bluetooth permission, including device control, device status acquisition, device discovery, and device network distribution. In these functions, we will communicate with terminal devices through Bluetooth. Please be aware that even if you have agreed to enable the Bluetooth permission, we will only use Bluetooth for communication in these scenarios: display equipment status on the home page and the device panel; control the device on the home page and the devoice panel; device discovery and device network distribution on the home page and the Add Equipment page.

You understand and agree that, for the above-mentioned additional services, you need to enable the access permissions to your location information (geographical location), webcam (camera), photo album (photo gallery), microphone (voice), and internal and external memory in your device, so as to collect and use the information involved in these permissions. You can check the status of above permissions item by item in your device settings, and you can decide whether to enable such permissions.

Please be aware that, by enabling any permission, you authorize us to collect and use relevant personal information to provide you with corresponding services, and by enabling any permission, you cancel the authorization, we will no longer continue to collect and use relevant personal information based on the corresponding permission, and we will not be able to provide you with the services corresponding to this permission. However, your decision to enable the permission will not affect the previous information collection and use based on your authorization.

3. Non-personally identifiable information

We may also collect other information that cannot be directly or indirectly used to identify a specific individual and is not personal information under applicable local laws. Such information is referred to as non-personal information. We may collect, use, transfer and disclose non-personal information, which may include:
  • Statistical data generated during your use of specific services (such as anonymous device-related information, daily events, page access events, page access duration events, and session events).
  • Network monitoring data (such as request duration, number of requests and error requests, etc.).
  • Application crash events (such as logs automatically generated after application crash, etc.).

  • Improve our service: We process your information on mobile device, usage, location and smart device, to ensure functionality and security of our products, develop and improve our products and services, analyze our operational efficiency, and prevent and track fraud or improper use. The legal basis for such processing is to perform our contract with you according to our User Agreement.
  • Non-marketing communication: We process your personal information to send you important information related to services, terms/conditions and policy changes and/or other management information. At the same time, we will also send you notices related to your purchase of services, including alarm services. The legal basis for such processing is to perform our contract with you according to our User Agreement.
  • Processing data based on Dongcheng's legitimate interests (under applicable jurisdictions, such as GDPR). Legitimate interests include enabling us to manage and operate our business and provide our products and/or services; safeguarding the security of our business, systems, products, services, and customers (including for the purposes of loss prevention and anti-fraud); internal administration; compliance with internal rules and processes; and other legitimate interests as described in this Privacy Policy.

For example, to ensure the security of our services and help us gain further insights into the performance of the application, we may record information such as your usage frequency, crash log information, overall usage patterns, performance data, and application source. To prevent unauthorized unlocking of devices, we may collect your account information, computer serial number, Internet protocol (IP) address, and device serial number and information.

  • Other purposes with your consent.

Regarding how we use your information, including potentially personal information, here are additional detailed examples:

  • Activation and registration of the smart devices or services you purchase.
  • Create and maintain your account. The personal information you provide when creating an account on a mobile device can be used to establish your personal account and profile page.
  • Provide other system services. The information collected when you use system services will be used to fulfill the functions of that service while also providing optimized service, such as downloading, updating, registering, executing, or optimizing activities related to system services.
  • Record geolocation information of photos. You can choose to record geolocation information when taking photos. This information will be visible in the photo folder and stored in the photo's metadata. If you do not wish to record geolocation information when taking photos, you can disable this feature at any time in the device camera settings.
  • Provide location-based services. When using system services, we or third-party service providers and business partners may use location information to provide services to you and offer a better user experience based on accurate location data. You can disable location services in the settings at any time.
  • Improve user experience through data, hardware, and software analysis. Optional features, such as allowing us to analyze data on how users use devices, system services, and other services we provide, are aimed at improving the user experience, such as sending crash reports. We also conduct hardware and software analysis to further enhance the user experience.
  • Collect user feedback. The feedback you choose to provide is essential in helping us improve our services. To address the feedback you provide timely, we may use the personal information you provide to contact you and keep records for problem resolution and service improvement.
  • Send notifications. We may use your personal information to send important notifications, such as notices regarding changes to our terms, conditions, and policies. Since such information is crucial for communication between you and us, we do not recommend opting out of receiving such notifications.

II. How We Use Cookies and Similar Technologies:

To enhance your experience using this application or the services we provide, we may identify your identity through small data files. This may help you skip repetitive information input or assist in protecting the security of your application account. These data may include cookies, flash cookies, or other local storage data provided by the operating system on your mobile device (collectively referred to as "cookies"), and they may also be used for trend analysis, managing the app, tracking your app activities, and collecting statistical information about the entire user base. We receive individual or aggregated analytical reports collected through the aforementioned technologies. These technologies help us better understand your behavior, such as which parts of our app you browse, measure the effectiveness of web searches, and make improvements accordingly.
  • Log file: We collect specific information and save it in the log file. Such information may include Internet Protocol (IP) addresses, browser types, Internet Service Providers (ISP), reference/exit pages, operating systems, date/time stamps, and/or click stream data. We will not associate the automatically collected log data with other information we collect.
  • Mobile analyses: In mobile application, we use analysis Cookie to collect information about how visitors use our App. The information collected by this type of Cookie includes the frequency of your use of this application, events occurring within this application, and the conditions of accumulated usage, performance data, and application crashes. We will not associate the information stored in analysis software with any personal data you submit to the mobile application.
  • How to reject the application of Cookie or similar technologies. You can reject or manage the cookie setting through your web browser settings. However, if you turn off Cookies, you may not be able to enjoy the best service experience and certain services, but this will not affect the core functions of our products and services.

III. Share your personal data with third party service providers

We will not sell any personal data to third parties. To assist us in providing you with the products and services described in this privacy policy, we may share your personal data with our third-party service providers and business partners as necessary. We guarantee to share personal data required to provide you with services solely for legitimate, lawful, necessary, specific and definite purposes. For example, when you access the App account, to ensure its security during your use, we may take different verification measures to identify your identity. For example, if your App account is logging in on a new mobile device for the first time, we may identify you through your App account and password, and including but not limited to verifying the check code sent to you by email.

We choose trusted, qualified third-party providers of cloud infrastructure to store this data, and all of your personal data is stored on controlled and secure servers for protection. We classify your information based on its importance and sensitivity, and ensure that your personal data has the corresponding security level. We regularly review information collection, storage, and processing practices, including physical security measures, to prevent unauthorized access and use.

We conduct due diligence on third party service providers and business partners to ensure their ability to protect your personal data. We will also check whether third parties have adopted appropriate security standards by implementing appropriate contract restrictions and conducting audits and evaluations as necessary. In addition, employees, third party service providers, and business partners who access your personal data comply with strict contract confidentiality obligations.

We will hold security and privacy protection training courses and tests to enhance employees' awareness of the importance of protecting personal data. We will adopt all feasible and legally required measures to protect your personal data.

We will deal with the disclosure of personal data according to applicable requirements in data protection regulations and, when necessary, promptly notify the relevant regulatory authorities and data subject of the data leakage.

We have established a personal data security incident reporting mechanism. Please understand that due to technical limitations and the possibility of various malicious means, an unfortunate personal data security incident may occur due to factors beyond our control. In the event of a security incident, where required by law, we will immediately inform you of the general truth and potential impact of the security incident, the disposal measures we have taken or will take, and provide you with recommendations for protecting information and reducing risks, as well as remedial measures. You provide sufficient information to enable us to verify your identity and ensure that you are the data subject or legally authorized to act on the data subject's behalf. Once we obtain sufficient information to confirm that your request can be processed, we shall respond to your request within any timeframe set out under your applicable data protection laws. In detail:

  • You have the right to be provided with clear, transparent and easily understandable information about how we use your personal data and rights. The above is why we provide you with the information in this Privacy Policy.
  • If any information we are holding on you needs to be corrected or completed, you are entitled to have your personal data corrected or completed based on the purpose of use.

2. Withdrawal of consent

When submitting a request by email, please describe in the email what information you would like to change, whether you wish to delete your personal data from our database, or what restrictions you would like us to have on us when using your personal data. We will process your request within a reasonable time from when the request was made, and after that, we will not collect, use, and/or disclose your personal data as promised. For security reasons, we may need to verify your identity before processing your request.

Depending on the extent of your withdrawal of consent, please note that you may not be able to continue receiving the full benefit of our products and services. The withdrawal of your consent or authorization, however, will not affect the validity of our processing carried out on the basis of the consent up until the point of withdrawal.

We may be requested to provide the means and instructions for withdrawal of consent.   • The information about your use of the smart device will not be collected by untying the smart device through the App;
  • Suppose you do not agree to the description in our Privacy Policy. In that case, you will be deemed to disagree to proactively provide us with personal data, disagree with us to grasp and process your personal data. By clicking the "Withdraw Consent" button under [More] - [User Agreement & Privacy Policy], you withdraw your consent, and then cancel your account, and we will no longer hold and process your personal data.

After you have withdrawn your consent or authorization, we will no longer provide you with the services requiring your authorization. However, the withdrawal of your consent or authorization will not affect our processing carried out based on the consent until the point of withdrawal. You do not have to pay anything to exercise your rights. We will respond to your request within 30 natural days in accordance with local information protection laws.

3. Canceling a service or account

You can cancel your App account in the App Account Settings. Before completing the cancellation, please provide some information to check and verify your identity as the App account owner. Please note that we will delete or cancel your personal data in a non-replicable and non-recoverable manner immediately after your App account is canceled.

VI. The way in which your personal is transferred around the world

TERRAINA is a multinational company. As such, your personal data we collect may be transmitted to other countries or regions. Specifically, our current cloud service provider hosts the application, stores the data, and collects information about application crashes and your usage behavior as follows:

(1) Support functions: Store and transfer data collected from our products and services; maintain the connection between your device and your App account & sub-account holders (if any).
(2) Types of information accessed: All information we collect as disclosed in this Policy.
(3) Permissions you need for your mobile device: NA
(4) How to get information from our products and services: as you ordered or instructed by us.

We are committed to supervising and urging the service provider to comply with the law and to use your personal data only for the purposes outlined in this Policy. The jurisdiction in which these global facilities are located may or may not protect personal data to the same standards as in your jurisdiction. There are different risks under different data protection laws. However, this does not change our commitment to complying with this Privacy Policy and protecting your personal data.

No matter where your information is stored, our privacy and security practices are designed to protect your personal data globally. For example, the European Commission has identified safeguards in place for adequate protection of personal data in certain countries/regions outside the European Economic Area (EEA), the United Kingdom (UK) or Switzerland. Suppose we transfer personal data originating from you in the EEA, Switzerland or UK to a recipient in the country/region outside the EEA, Switzerland or UK who is not considered to have an adequate level of information protection.
